  1.    ELECTRONIC END USER LICENSE AGREEMENT
  2.    FOR PE EXPLORER version 1.92

  4.    NOTICE TO USER: CAREFULLY READ THE FOLLOWING LEGAL 
  5.    AGREEMENT. BY INSTALLING THIS SOFTWARE YOU ACCEPT 
  6.    ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

  8.    This Heaventools Software ("Heaventools") End User License Agreement 
  9.    accompanies the Heaventools PE Explorer product and related explanatory 
  10.    materials ("SOFTWARE"). The term "SOFTWARE" also shall include any 
  11.    upgrades, modified versions or updates of the Software licensed to you 
  12.    by Heaventools. By installing and/or using the enclosed, attached, or 
  13.    about-to-be-installed software you are agreeing to be bound by the terms 
  14.    of this End User License Agreement. If you do not agree to the terms of 
  15.    this End User License Agreement, promptly stop the installation process, 
  16.    cease to use SOFTWARE, and erase this SOFTWARE and all of its 
  17.    associated files from your system.
  18.  
  19.   1. LICENSE GRANT.
  20.  
  21.     Heaventools grants to you a nonexclusive license to use one copy 
  22.     of the version of this SOFTWARE on any one hardware product for as 
  23.     many licenses as you purchase. "You" means the company, entity or 
  24.     individual whose funds are used to pay the license fee. "Use" means 
  25.     storing, loading, installing, executing or displaying the SOFTWARE. 
  26.     If you install the SOFTWARE onto a multi-user platform or network, 
  27.     each and every individual user of the SOFTWARE must be licensed
  28.     separately or be covered by a site license.
  29.     You may not modify the SOFTWARE or disable any licensing or
  30.     control features of the SOFTWARE except as an intended part of
  31.     the SOFTWARE's programming features. When you first obtain a copy
  32.     of the SOFTWARE, you are granted an evaluation period of not more
  33.     than 30 days, after which time you must pay for the SOFTWARE
  34.     according to the terms and prices discussed in the SOFTWARE's
  35.     documentation, or you must remove the SOFTWARE from your computer.
  36.     This license is not transferable to any other hardware product or
  37.     other company, entity, or individual. You are expected to use the
  38.     SOFTWARE on your system and to thoroughly evaluate its usefulness
  39.     and functionality before making a purchase.
  40.     This "try before you buy" approach is the ultimate guarantee that
  41.     the SOFTWARE will perform to your satisfaction.

  43.     Any use of the SOFTWARE which is illegal under international or
  44.     local law is forbidden by this licence. Any such action is the sole
  45.     responsibility of the person committing the action.

  47.   2. OWNERSHIP.
  48.  
  49.     The SOFTWARE is owned and copyrighted by Heaventools Software.
  50.     Your license confers no title or ownership in the SOFTWARE and 
  51.     should not be construed as a sale of any right in the SOFTWARE.

  53.   3. COPYRIGHT.
  54.  
  55.     The SOFTWARE is protected by copyright, including without limitation
  56.     by United States Copyright Law, international treaty provisions and
  57.     applicable laws in the country in which it is being used. You 
  58.     acknowledge that no title to the intellectual property in the SOFTWARE 
  59.     is transferred to you. You further acknowledge that title and full 
  60.     ownership rights to the SOFTWARE will remain the exclusive property of 
  61.     Heaventools and you will not acquire any rights to the SOFTWARE except 
  62.     as expressly set forth in this license.
  63.     You agree that any copies of the SOFTWARE will contain the same
  64.     proprietary notices which appear on and in the SOFTWARE.
  65.  
  66.   4. RESTRICTIONS.
  67.  
  68.     You agree that you will not attempt to modify, adapt, translate, reverse 
  69.     engineer, decompile, clone, disassemble the SOFTWARE in whole or in part, 
  70.     or otherwise attempt to discover the source code of the SOFTWARE (except 
  71.     and solely to the extent an applicable statute expressly and specifically 
  72.     prohibits such restrictions). You may not alter or modify the installer 
  73.     program or create a new installer for the SOFTWARE. You may not sublicense, 
  74.     rent, lease, resell for profit or otherwise dispose of the SOFTWARE 
  75.     without our written permission. You may not grant a security interest in, 
  76.     or otherwise transfer rights to the SOFTWARE. You may not remove any 
  77.     proprietary notices or labels on the SOFTWARE.

  79.     Usage of the SOFTWARE may violate the copyright of the modified
  80.     material. It is your responsibility to respect all legal aspects.
  81.     You don't have the right to release to public any programs which
  82.     were altered using the SOFTWARE, if not expressively granted by the
  83.     respective authors.

  85.   5. DISCLAIMER OF WARRANTY.
  86.  
  87.     THIS SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED
  88.     ON AN "AS IS" BASIS AND YOU ASSUME FULL RESPONSIBILITY
  89.     FOR DETERMINING THE SUITABILITY OF THE PROGRAM AND FOR
  90.     RESULTS OBTAINED. HEAVENTOOLS DISCLAIMS ALL WARRANTIES
  91.     RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR
  92.     IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED
  93.     WARRANTIES OF MERCHANTABILITY, FREE OF DEFECTS, FITNESS 
  94.     FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD
  95.     PARTY RIGHTS. NEITHER HEAVENTOOLS NOR ANYONE ELSE WHO
  96.     HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR 
  97.     DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT,
  98.     CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES (INCLUDING,
  99.     WITHOUT LIMITATIONS, DAMAGES FOR LOSS OF BUSINESS PROFITS,
  100.     BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, 
  101.     DATA LOSS, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF
  102.     THE USE OR INABILITY TO USE SUCH SOFTWARE, EVEN IF 
  103.     HEAVENTOOLS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  104.     DAMAGES OR CLAIMS. THE PERSON USING THE SOFTWARE BEARS
  105.     ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE
  106.     SOFTWARE. SHOULD THE SOFTWARE PROVE DEFECTIVE IN ANY
  107.     RESPECT, YOU AND NOT HEAVENTOOLS OR ITS SUPPLIERS ASSUME
  108.     THE ENTIRE COST OF ANY SERVICE AND REPAIR.

  110.     SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION
  111.     OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
  112.     LIMITATIONS OR EXCLUSION MAY NOT APPLY TO YOU TO THE
  113.     EXTENT THAT LIABILITY IS BY LAW INCAPABLE OF EXCLUSION OR
  114.     RESTRICTION.

  116.     IN NO EVENT SHALL ANY THEORY OF LIABILITY EXCEED THE
  117.     LICENSE FEE PAID TO HEAVENTOOLS.
  118.  
  119.   6. SEVERABILITY.

  121.     Any term or provision of this Agreement held to be illegal or 
  122.     unenforceable shall, if possible, be interpreted so as to be construed 
  123.     as valid, but in any event the validity or enforceability of the 
  124.     remainder hereof shall not be affected.

  126.   7. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.

  128.     IN NO EVENT SHALL HEAVENTOOLS OR ITS SUPPLIERS BE LIABLE
  129.     TO YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL OR
  130.     INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY,
  131.     PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF HEAVENTOOLS
  132.     HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO
  133.     EVENT WILL HEAVENTOOLS' LIABILITY FOR ANY CLAIM, WHETHER IN
  134.     CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED
  135.     THE LICENSE FEE PAID BY YOU, IF ANY. HEAVENTOOLS SHALL HAVE
  136.     NO OBLIGATION TO YOU WITH RESPECT TO ANY CLAIM OF
  137.     INFRINGEMENT BASED UPON YOUR USE OF THE SOFTWARE IN 
  138.     COMBINATION, OPERATION OR OTHERWISE WITH THE DATA OR
  139.     MATERIALS NOT SUPPLIED BY HEAVENTOOLS.

  141.   8. TERMINATION.

  143.     This Agreement and the license granted hereunder will terminate
  144.     automatically if you fail to comply with the limitations described
  145.     herein. Upon termination, you must destroy all copies of the SOFTWARE
  146.     and documentation.

  148.   9. ENTIRE AGREEMENT.
  149.  
  150.     This is the entire agreement between you and Heaventools which
  151.     supersedes any prior agreement or understanding, whether written or
  152.     oral, relating to the subject matter of this license.

  154.  10. RESERVED RIGHTS.
  155.  
  156.     All rights not expressly granted here are reserved to Heaventools
  157.     and/or the respective authors (listed either in the documentation
  158.     or within the SOFTWARE).
  159.  
  160.     Heaventools reserves the right to make exceptions to any of these
  161.     conditions, or alter these conditions, at any time. However, you
  162.     may always use these conditions instead of any altered version if
  163.     you prefer (note that this licence explicitly applies only to one
  164.     version of the program; therefore, if Heaventools makes new
  165.     conditions in connection with a future version, you do not then have
  166.     the right to apply these conditions to that version instead).
